The rental property is solely for private holiday use, and any commercial or other use is prohibited.
The rental agreement between the tenant and the landlord becomes legally binding upon completion of the booking. During the booking process, the tenant confirms that they have legal capacity (at least 18 years of age and ability to enter into legally binding contracts). The GTC are considered accepted once the tenant activates the corresponding confirmation field during the booking process. Bank transfer fees are borne by the tenant (“OUR payment”).
If the payment is not made on time – refer to rent payment hereafter, the landlord may withdraw from the contract after a short grace period has expired without success and rent the property to someone else; alternatively, the landlord may insist on fulfilment of the contract and claim cancellation fees. The rental property may only be occupied by the specified people during the booking process.
The total price must be paid within 10 days of booking. The reservation is considered definitively confirmed upon receipt of payment. If the booking is made less than 30 days before arrival, the total amount is due immediately.
The rental property will be handed over to the tenant in a clean and contractually compliant state. Any defects or missing inventory must be reported to the key holder/landlord immediately. Failure to do so will imply that the property was handed over in perfect condition.
If the tenant is late or fails to take over the property, the full rental price is still applicable. The te-nant is responsible for punctual arrival, and any hindrances to arrival (such as traffic or road clo-sures) are the tenant’s responsibility. When traveling from abroad, the tenant should be informed about Switzerland’s entry regulations in advance.
The landlord or key holder may request identification to verify the tenants‘ identity. Individuals not listed in the rental agreement may be denied entry, and the full rent remains payable.
The lessee is responsible for ensuring and guarantees that housemates, including guests comply with the obligations arising from this agreement. The rental property may only be occupied by the specified people during the booking process. Subletting, assignment of the rental agreement, or transferring the rental property to other people is not permitted.
The rental property is designed for a maximum of 6 persons, including children. Occupancy by more persons is only possible in exceptional cases, subject to prior consultation with the landlord and for an additional fee. Pets, such as dogs, cats, birds, reptiles, rats, ferrets, guinea pigs, hamsters, etc., are not allowed.
The tenant agrees to use the property responsibly, adhere to the house rules, and respect other residents and neighbors. Any damages must be reported to the landlord/keyholder promptly.
If tenants, housemates, or guests breach the rules of careful use or if the property is occupied by more people than agreed upon, the landlord/keyholder may terminate the contract without notice or compensation after a failed written warning. Rent payment is still required in this scenario, and the right to pursue further claims and damages is reserved.
The tenant is required to return the rented property on time and in a clean condition, including all inventory. Even if final cleaning is part of the rental agreement, the tenant is still responsible for cleaning the kitchen equipment, such as dishes and utensils. The tenant will be held liable for any damages to the furnishings or missing inventory and may be required to pay compensation.
For cancellations up to 30 days before arrival, a cancellation fee of 40% of the total price will be charged.
For cancellations less than 30 days before arrival, the full price is due.
If the property can be re-rented after a cancellation, the landlord will refund the rental amount mi-nus a cancellation fee of CHF 50.–.
In the event of early departure or interruption of the stay, the full price remains due.
Guests are advised to take out travel and cancellation insurance covering costs in the event of illness, accident, death, or natural disasters.
If force majeure (environmental disasters, force of nature, etc.), official measures, unforeseeable or unavoidable events prevent the rental or its continuation, the landlord is entitled (but not obliged) to offer the tenant an equivalent replacement property, excluding any claims for com-pensation. If the service cannot be provided or cannot be provided in full, the amount paid or the corresponding share for the services not provided will be refunded to the exclusion of any further claims.
The lessee is liable for all damage caused by the lessee or housemates, including guests. Fault is presumed. If damages should be found after the return of the leased property, the lessee is al-so liable for these, provided that the lessor can prove that the lessee (or his housemates or guests) have caused the damage. Use of the indoor slide and the hanging cave is at the tenant’s own risk. Tenants are liable for their children.
The lessor guarantees proper reservation and contractual fulfilment of the agreement. The liability of the lessor is excluded to the extent permitted by law. Liability is excluded especially for acts and omissions on the part of the lessee (including housemates and guests), unforeseeable or unavoidable omissions by third parties, force majeure or events which the lessor, key holder, agent or other persons called upon by the lessor could not foresee or avoid despite all due care.
The lessor is subject to the data protection laws of Switzerland and shall process the data in accordance with these regulations. Based on the local laws, the lessor may be obliged to register the lesse and his housemates with the local authorities. To protect legitimate interests or in the event that a criminal act is suspected, the lessor reserves the right to disclose the lessee’s data and/or those of his housemates and guests to the responsible authorities or request third parties to enforce his rights.
Applicable law and place of jurisdiction
Swiss law shall be solely applicable. It is agreed that the locality where the leased property is si-tuated shall be the exclusive place of jurisdiction. Subject to mandatory contractually unchangeable provisions of law.
